Anthropic Claims DeepSeek Used Claude to Train Competing AI Models

US artificial intelligence company Anthropic has accused Chinese startup DeepSeek of improperly using its AI model Claude to train competing systems.

The allegations, made public this week, claim that developers created thousands of accounts to extract high-quality outputs from Claude at scale.

The dispute has raised fresh concerns about AI intellectual property, model security and the global race to build more powerful systems.

The claims matter because frontier AI models like Claude are increasingly seen as strategic assets. If rival firms can replicate their capabilities through large-scale “distillation”, it could reshape competition, regulation and even national security policy.

What Is Anthropic Alleging Against DeepSeek?

Anthropic says DeepSeek, along with Moonshot AI and MiniMax, generated tens of thousands of user accounts to interact with Claude.

According to the company, these accounts produced millions of structured prompts designed to extract advanced reasoning, coding solutions and analytical responses.

Rather than normal user activity, Anthropic describes the campaign as systematic and coordinated.

A spokesperson for the company stated: “We have identified patterns consistent with large-scale automated querying intended to reproduce Claude’s advanced capabilities.”

The company claims this behaviour violates its platform terms and potentially undermines safety protections built into Claude.

What Does ‘Distillation’ Mean in AI Development?

Distillation is a legitimate machine learning technique. Developers often train a smaller, cheaper model to imitate a larger, more advanced one. The smaller model learns by studying outputs generated by the larger system.

In universities and open research environments, distillation improves efficiency and reduces computing costs. It helps compress knowledge into lighter systems that run on fewer resources.

However, the company argues that scale and intent make the difference.

If a firm systematically queries another company’s proprietary model without permission to replicate its strengths, that shifts from research efficiency to capability extraction.

There is currently no global legal framework that clearly defines when distillation becomes infringement. Enforcement relies largely on API monitoring, contractual agreements and national export rules.

Why Does This Matter for the UK and Global AI Policy?

The dispute lands at a sensitive moment in global AI governance. The UK hosted the AI Safety Summit at Bletchley Park in November 2023, positioning itself as a mediator in frontier AI regulation.

The firm has previously worked with governments on AI safety frameworks. Meanwhile, the US has tightened export controls on advanced AI chips to China since 2022, citing national security concerns.

If frontier models can be replicated through querying rather than hardware access, export restrictions on semiconductors may lose some effectiveness.

For the UK government, which aims to balance AI innovation with regulation, this case highlights key policy questions:

  • How should intellectual property apply to AI outputs?
  • Can API-based monitoring prevent misuse?
  • Should AI model safeguards be legally protected?

How Fast Are Chinese AI Labs Advancing?

Chinese AI developers have continued advancing despite limited access to high-end US semiconductors. DeepSeek recently showcased competitive reasoning benchmarks using fewer computing resources than Western rivals.

Industry analysts suggest efficient training strategies, including possible distillation methods, help close the gap.

The company’s wider ambitions have also surfaced in discussions around defence technology and national planning, particularly in reports examining how China is deploying DeepSeek in military strategy

Earlier in 2024, other major AI developers also raised concerns about potential model replication techniques, signalling that this is not an isolated worry within the sector.

Critics note, however, that many large language models, including Western ones, were trained on vast volumes of publicly available internet data. That complicates debates about originality and derivative learning.

Could This Lead to Regulatory Change?

There is currently no internationally harmonised rulebook governing AI model distillation.

The UK’s regulatory approach remains principles-based, with oversight split across bodies such as the Information Commissioner’s Office and the Competition and Markets Authority.

If disputes like this intensify, governments may:

  • Introduce stricter API monitoring standards
  • Clarify ownership rights over AI-generated outputs
  • Expand export control definitions to include model capabilities
