Belfast Shop Fined for Nicotine Sales to Minors

A Belfast retailer has been fined after illegally selling a nicotine product to an underage customer, in a case brought forward by Belfast City Council.

Michael O’Reilly, proprietor of O’Reilly’s store on Donegall Street, pleaded guilty on 10 June at Belfast Magistrates’ Court to the offence of selling a nicotine inhaling product to a person under the age of 18.

The prosecution came as a result of a test purchase carried out by Council officers, which confirmed that a minor was able to buy the product in-store. The operation was part of ongoing efforts to clamp down on nicotine sales to minors, which remains a growing concern in Northern Ireland.

According to the Tobacco Retailers Act (Northern Ireland) 2014, it is strictly prohibited for any retailer to sell tobacco or nicotine inhaling products—such as vapes or e-cigarettes—to anyone under 18 years of age.

Following the conviction:

  • Mr O’Reilly received a £1,200 fine
  • He was also ordered to pay £78 in costs
  • His shop is now under an 18-month Restricted Premises Order
  • He personally faces an 18-month Restricted Sales Order

These restrictions prevent him and his business from selling nicotine-related products during the penalty period.

In a statement released after the court ruling, a spokesperson for Belfast City Council said: “Anyone who has concerns or information about illegal, or underage sales of such goods should report it to the Belfast City Council Tobacco Control Team on 028 9027 0428.”

The Council reaffirmed its zero-tolerance stance on the sale of nicotine products to minors, highlighting the health risks and legal implications associated with such offences.

This case serves as a stark reminder to retailers across Northern Ireland about the importance of age verification when selling nicotine or tobacco products. Selling to minors not only puts young people’s health at risk but also carries serious legal and financial consequences for businesses.

Retailers are urged to:

  • Ensure all staff are trained in age verification protocols
  • Display clear signage about the legal age for nicotine purchases
  • Cooperate fully with enforcement efforts to maintain public health standards
